According to Deputy Minister of Industry and Commerce Do Thang Hai, on the progress of building the Decree amending Decree No. 95/2021/ND-CP as well as Decree No. 83/2014/ND-CP on administration and the business with petroleum. On December 1, 2022, the government office sent an official message to inform the heads of government of the government’s instructions and tasked the Ministry of Industry and Commerce to draft the decree in accordance with the abridged order and procedures in accordance with the provisions of Decree No. Law for promulgation of legal documents.
“Although the rules of the abbreviated procedure do not require consultation of the subjects, we nevertheless consulted right from the first draft. Therefore, we have received many comments,” said Mr. Hai.
Stressing that this decree will directly regulate many different issues with different and even conflicting interests, Mr Hai said that having many opinions is understandable.
“At present, the Ministry of Industry and Commerce is working very closely with ministries, sectors and associations,” Deputy Minister Do Thang Hai said.
On February 14, the Ministry of Industry and Trade, in coordination with the Vietnam Confederation of Trade and Industry (VCCI), organized a workshop to comment on the draft decree amending Decree No. 95/2021/ND-CP and Decree No. 83/ 2014 /ND-CP on petroleum trading. Next, the ministry coordinated with a number of members of the press, most recently the Tien Phong newspaper, to organize a seminar “Petroleum trade and the problem of ensuring national energy security – Voice of insiders”.
“We have aggregated all comments and assigned them to the drafting committee and drafting team to further develop this decree in accordance with reality and meet the opinions of all subjects at the highest level.” Mr. Hai informed, stressing that “No Whether it is a decree acts, any legal document can never be perfected but can only be the best; the best method and plan ever. That might be the best option right now, but next year that could change.”
Therefore, in reviewing this change, the Department of Industry and Trade has received many comments from companies, such as the Regulation on the Minimum Discount Level for Business Activities.
“We reiterate that the recommendations of petroleum companies, as well as other subjects, are and will be carefully studied and examined by the drafting committee to ensure that the draft decree is prepared on the basis of the best possible absorption of the opinions of the subjects concerned and meets the requirements, in Correspondence to the actual situation, publicity, transparency, efficiency and must balance the interests of the state, people and businesses in accordance with the instructions of the government as well as the prime minister,” the chairman confirmed the Ministry of Industry and Trade.
